Justice S.M. Shuaibu of the Federal High Court in Kano has struck out a suit filed by the immediate past Kano State Deputy Governor, Aminu Abdulsalam Gwarzo, seeking to stop impeachment proceedings initiated by the Kano State House of Assembly.
The Assembly had on March 5 commenced impeachment proceedings against Gwarzo, who reportedly refused to defect to the All Progressives Congress (APC) alongside Governor Abba Kabir Yusuf from the New Nigeria People’s Party (NNPP).
Gwarzo approached the Federal High Court on March 25 to halt the impeachment process, but Justice Shuaibu struck out the case after Umar Danbaito, counsel to Gwarzo, informed the court on Thursday of his client’s decision to discontinue the suit.
The court had earlier declined to grant an interim order to stop the impeachment process and instead ordered that the Assembly be put on notice to show cause why such an order should not be granted, adjourning the matter to April 16.
The impeachment notice, endorsed by 38 lawmakers, was said to be in line with Section 188 of the 1999 Constitution (as amended).
The allegations against Gwarzo include receiving kickbacks from the 44 local government councils in the state between June 2023 and January 2024.
