Man in custody for beating up soldier who found him in matrimonial bedroom with his wife

What began as a late-night return home for one Army officer ended in a courtroom conviction after he found an unexpected intruder hiding in his matrimonial bedroom.

The Magistrate’s Court has convicted 35-year-old physicist Dickson Musopelo of assault occasioning actual bodily harm, following an incident that unfolded on the night of September 26, 2025.

How soldier was attacked

Magistrate Victoria Mututwa delivered the verdict after a full trial, ruling that the prosecution had proved its case beyond reasonable doubt.

The court heard that the complainant, Chisha, an army officer, arrived at his home shortly after 10 pm and proceeded to his bedroom, only to discover Musopelo inside with his wife.

According to evidence, the wife allegedly urged Musopelo to hide in a wardrobe, but he was discovered. Instead of fleeing, Musopelo reportedly attacked the soldier, punching him and causing bodily harm.

State Advocate Georgina Daka, who led the prosecution, presented evidence that remained consistent under cross-examination.

What did Musopelo’s witnesses say?

Despite efforts by the defence to challenge the case, the court found the prosecution’s version of events credible and convincing.

In his defence, Musopelo called two witnesses, including his sister, Martha Musopelo. She told the court that her brother arrived at her home the following day with a swollen left eye, bleeding and missing two teeth.

Concerned for his condition, she said she took him to Kabwata Police Station to obtain a medical report before seeking treatment at the University Teaching Hospitals.

However, under questioning, she admitted she had not witnessed the incident and could not confirm what had transpired. She also acknowledged that the medical report described her brother’s condition as stable.

Magistrate’s ruling

A medical doctor, Dr Sithokozile Nandazi, also testified that Musopelo had complained of jaw pain, neck bruises, nausea and broken teeth, which he said resulted from an altercation.

She told the court that he had briefly lost consciousness. But during cross-examination, Dr Nandazi conceded that no dental examination had been conducted to confirm the broken teeth, and no photographs or physical evidence of the injuries were presented in court.

She also admitted that the injuries could have been caused by another person or even self-inflicted, while confirming that Musopelo was stable at the time.

In her ruling, Magistrate Mututwa found that the defence had failed to raise reasonable doubt about the prosecution’s case.

She concluded that the evidence clearly showed Musopelo assaulted the soldier, resulting in actual bodily harm.

Musopelo has since been convicted and remains in custody as he awaits sentencing, bringing a dramatic and deeply personal case to a decisive legal conclusion.

Officer beaten by motorist promoted

Meanwhile, a traffic police officer who was violently attacked and beaten by a motorist while carrying out his official duties has been promoted to the rank of Sergeant.

The officer, whose composure during the shocking incident drew widespread sympathy, had been filmed being kicked and punched by a motorist during a confrontation on the road.

Police later identified the suspect as Dr Emmanuel Njovu, a 32-year-old medical doctor, who has since been detained.
