An Ilorin Revenue Court in Kwara State on Wednesday has reinstated Hon. Saba Yisa Gideon while dismissing his suspension by the House of Assembly on grounds of being illegal and unconstitutional.
The lawmaker, who represents Edu State Constituency, was suspended by the House of Assembly on December 18, 2025, for three months on the basis of recording meeting proceedings without consent and forwarding the recording to an unauthorised person.
Dissatisfied with the decision, Hon Gideon dragged the Speaker and other members of the House of Assembly to court, seeking a overturn of the suspension.
In a judgment that lasted over one hour, Justice Muritala Folorunsho ruled that the suspension was carried out through a motion without notice, describing it as a breach of the lawmaker’s procedural rights.
The court held that the action of the House was not supported by the relevant provisions of the Legislative Houses, Powers and Privileges Act and the Rules of the Kwara State House of Assembly.
Justice Folorunsho declared the suspension unconstitutional, unlawful, null and void, and of no legal effect. He also set aside the three-month suspension imposed on the lawmaker.
The court granted an injunction restraining the respondents from interfering with Gideon’s legislative duties or preventing him from accessing the Assembly complex, including his office and committee rooms.
The judge further ordered that all salaries and entitlements due to the lawmaker during the period of suspension be paid, directing both parties to bear their respective costs.
