*Seeks N20bn in Damages
Mosakab Nigeria Limited and its promoter, Mashood Mustapha, have filed a high-stakes lawsuit at the Federal High Court in Abuja against telecommunication giant Glo Mobile Limited, the Nigerian Communications Commission (NCC), and indigenous firm Megatech Engineering Limited over an alleged breach of contractual obligations. The suit, marked FHC/ABJ/CS/1534/2024, claims the defendants failed to honor a consultancy agreement, leaving Mosakab out of over $9.5 million owed.
Represented by George Ibrahim SAN of the Ogwu James Onoja SAN law firm, the plaintiffs are seeking a court order to void or set aside Megatech’s sale of a 2.6 GHz Spectrum Licence to Glo Mobile, claiming the transaction was tainted by fraud and illegality.
Mosakab also demands that Megatech fulfill its $10 million obligation under a June 29, 2017, consultancy agreement, of which only $421,052 has been paid. The plaintiffs are further asking the court to compel the NCC to revoke the 2.6 GHz Spectrum Licence issued to Megatech in March 2020, facilitated by Mosakab’s consultancy services. They are seeking N5 billion for breach of contract, N10 billion in general damages, 5–10 percent of Megatech’s outstanding shares, and N50 million in litigation costs.
According to the statement of claim, Megatech engaged Mosakab in 2017 to act as consultants in securing a 2.5/2.6 GHz National Licence, with Mosakab deploying human and material resources. Following interactions with government agencies, the NCC granted Megatech a 40 MHz (TDD) Spectrum Licence on March 26, 2020, for nationwide deployment over five years.
The plaintiffs allege they also assisted Megatech in sharing the spectrum band with Glo Mobile, investing $250,000, only for Megatech to renege on the $10 million fee and sell its interest without settling the balance.
“Megatech took the benefits of the Spectrum Band allocation and entered into an agreement with Glo Mobile to sell its interest without paying the outstanding USD 9,578,947,” the suit states.
Justice Mohammed Garba Umar has fixed March 3, 2026, for the hearing of the case.
