Again, “Court Halts Tinted Glass Permit Policy Set For January 2026” — Police, Contractors Ordered Not To Enforce Policy

The High Court of Justice, Delta State, Orerokpe Judicial Division, has granted an interim injunction restraining the Inspector General of Police and the Nigeria Police Force from implementing and enforcing the tinted glass permit policy set to commence on January 2, 2026.

The order, issued on Wednesday, December 17, 2025, by Hon. Justice Joe Egwu, followed a motion exparte filed by Mr. Israel Joe, represented by a legal team led by Kunle Edun, SAN.

In the suit marked HOR/FHR/M/31/2025, the court granted three key interim injunctions pending the hearing and determination of the substantive application:

First Order: The court restrained the 1st and 2nd Respondents (Inspector General of Police and the Nigeria Police Force), their officers, men, agents, privies and/or contractors from implementing/enforcing and/or further implementing/enforcing the tinted glass permit policy set to commence on January 2, 2026.

Second Order: The court restrained the 1st and 2nd Respondents, their officers, men, agent, privies and/or contractors from stopping, harassing, arresting, detaining, extorting or otherwise interfering with the constitutional rights to dignity, privacy, freedom of movement and ownership of property of the Applicant (and citizens/motorists) under the guise of enforcing the Tinted Glass permit policy.

Third Order: The court restrained the 1st and 2nd Respondents, their officers, men, agent, privies and/or contractors from continuing to use the PARKWAY PROJECTS Account (a private contractor’s account) to conduct any government business.

The court also ordered substituted service on the 1st and 2nd Respondents through the 3rd Respondent (The Commissioner of Police, Delta State Police Command) at the Delta State Police Command Headquarters, Asaba, and for such service to be deemed as good and proper service.

The Applicant was represented by a formidable legal team comprising Kunle Edun (SAN), Ikechukwu Ogbonna Esq., E.O. Onoriode Esq. S.C. Okporgu Esq., T.L. Doigboghie Esq., A.H. Okifo Esq., Sir F.O. Yekovie and J.K. Ezugwu Esq.

The court heard from all counsel and ordered that the Motion Exparte dated and filed December 17, 2025, be granted as prayed.

The hearing of the motion on notice has been fixed for December 24, 2025.

The case was called on Wednesday, December 17, 2025, but the Applicant was absent.

The order comes amid ongoing controversy over the Nigeria Police Force’s plan to resume enforcement of tinted glass permit regulations starting January 2, 2026.

The police had earlier announced the resumption of nationwide enforcement, citing rising security risks and the use of vehicles with unauthorized tinted glass to conceal identities during armed robbery, kidnapping, and violent crimes.

However, the Nigerian Bar Association (NBA) and other stakeholders have raised concerns about the enforcement, with some threatening contempt proceedings against the Inspector-General of Police.

The order was issued at the High Court of Justice, Orerokpe, under the hand of the Presiding Judge and the seal of court on December 17, 2025.
