NEW ORLEANS (WGNO) — New Orleans Mayor LaToya Cantrell has filed a lawsuit against Louisiana Secretary of State Kyle Ardoin, alleging that he unconstitutionally brokered a settlement with NOLATOYA campaign leaders to impeach the mayor .
Earlier this month, a court ruled that approximately 25,000 Orleans Township voters originally listed as active would be listed as inactive. This resulted in reducing the number of signatures required for the recall petition – something NOLATOYA organizers Eileen Carter and Belden Batiste said was a win.

Cantrell’s attorneys, Marion Floyed and Ron Wilson, filed a petition to overturn or otherwise invalidate Ardoin”s final judgment to reduce the signature count.

In addition, the mayor’s legal team has asked for a mandamus writ, asking the secretary of state to show what authority he used to negotiate an agreement with the organizers of the recall. Attorneys believe Ardoin did not have the authority to make the signature count change and claim that he essentially rewrote the law that sets standards for recall elections in Louisiana.
WGNO has reached out to the Secretary of State’s office for comment on the lawsuit, but has not yet heard a response.
Recall leaders say they stand by Ardoin’s decision to remove the 25,000 voters from active lists and say the New Orleans public deserves the truth.
